Wade&nbsp;that some citizen-led bids to restore access failed.<\/span> <\/p> <p> Organizers with campaigns in Arkansas, Florida, Nebraska, and South Dakota spoke with States Newsroom about what went wrong. A few said they\u2019re not giving up the fight, and one group hopes to get the question on the ballot in 2026.  \n<\/p> <p> In Arkansas, voters could have had a chance to decide whether to allow the right to an abortion up to 18 weeks post-fertilization and beyond in cases of rape, incest, fatal fetal anomalies, or to protect patient\u2019s life or physical health.  \n<\/p> <p> But the question never made the ballot. The secretary of state disqualified around 14,000 of more than 100,000 signatures submitted by Arkansans for Limited Government, the group behind the proposed constitutional amendment, according to <a href=\"https:\/\/www.newsfromthestates.com\/article\/arkansas-secretary-state-defends-rejection-proposed-abortion-amendment\">Arkansas Advocate<\/a>. Measures require 90,704 signatures to make the ballot in the state.  \n<\/p> <p> The election official said the signatures were invalid due to a paperwork error, and the state Supreme Court agreed with his decision in August, the <a href=\"https:\/\/www.newsfromthestates.com\/article\/updated-paperwork-errors-will-keep-proposed-arkansas-abortion-amendment-ballot\">Arkansas Advocate<\/a>&nbsp;reported.  \n<\/p> <p> Gennie Diaz, Arkansans for Limited Government\u2019s spokesperson, said the defeat was \u201cdevastating because we felt very much like the facts were on our side, the law was on our side, and that we did everything that was required of us.\u201d  \n<\/p> <p> All abortions are illegal in Arkansas except to save the life of the mother. Doctors violating the law could be fined up to <a href=\"https:\/\/www.newsfromthestates.com\/see-data-reproductive-rights?eType=EmailBlastContent&amp;eId=951f85a0-01a6-4004-a790-9348118c04aa\">$100,000 and serve up to 10 years<\/a>&nbsp;in prison. <a href=\"https:\/\/healthy.arkansas.gov\/wp-content\/uploads\/Induced_Abortion_2023_vital_stat.pdf\">No abortions<\/a>&nbsp;were reported to the state Department of Health in 2023, the latest info available.  \n<\/p> <p> While canvassing, the group spent a lot of time informing Arkansans about the law \u2014 some residents didn\u2019t know the ban was in effect \u2014 and telling them about medical emergencies that arise during pregnancies that require abortions, Diaz said. The Arkansas Family Council published a list of paid canvassers and their home cities in June, a move Arkansans for Limited Government denounced as an <a href=\"https:\/\/www.newsfromthestates.com\/article\/publication-abortion-amendment-canvasser-list-intimidation-ballot-question-committee-says\">intimidation tactic<\/a>.  \n<\/p> <p> Arkansans for Limited Government is looking to mount another abortion-rights initiative, she said, but the group will need financial support. \u201cOne of the biggest takeaways from our experience is that you do need substantial funding, robust funding up front in order to make sure your ducks are in a row and you have a really solid plan,\u201d Diaz said.  \n<\/p> <p> The abortion-rights committee raised $306,314 in July, the penultimate month of the campaign, <a href=\"https:\/\/www.newsfromthestates.com\/article\/arkansas-chicken-magnate-gives-100000-plus-group-opposing-abortion-marijuana-amendments\">Arkansas Advocate<\/a> reported. Arkansas Family Council reported more than $238,000 at the end of July to oppose the abortion amendment, and Stronger Arkansas \u2014 a group with ties to Gov. Sarah Huckabee Sanders \u2014 had about $475,000 during that period, according to the Advocate.  \n<\/p> <p> Diaz said national funding is crucial to a successful abortion-rights amendment: \u201cI don\u2019t think it necessarily has to come from Planned Parenthood and ACLU National. That\u2019s typically who it has come from. But it is just the bare bones truth that in order for a ballot initiative to be successful, you have to have millions of dollars, even in a small state like Arkansas.\u201d  \n<\/p> <figure> <span>Florida<\/span> <\/figure> <p> Lack of money wasn\u2019t an issue in Florida, where voters weighed whether to allow abortion before fetal viability and when a provider determines the procedure is medically necessary. The abortion-rights group behind Amendment 4 had more than $121 million in total contributions, according to state campaign finance data.  \n<\/p> <p> Several opposition committees popped up ahead of the election, including Do No Harm, Florida Voters Against Extremism \u2014 publicly known as \u201cNo on 4\u201d \u2014 Keep Florida Pro Life and Life First PC. Republican Gov. Ron DeSantis created the Florida Freedom Fund to oppose abortion and marijuana initiatives. DeSantis\u2019 PAC had $7.3 million in contributions, according to state campaign finance data.  \n<\/p> <p> What set the counter-campaign apart in Florida was the DeSantis administration\u2019s tactics in opposing the effort. It\u2019s unclear how much the state government spent to oppose the abortion-rights ballot measure, but the governor ramped up <a href=\"https:\/\/www.newsfromthestates.com\/article\/desantis-again-laments-gop-members-who-are-not-publicly-opposing-amendment-4\">critiques<\/a>&nbsp;\u2014 even against members of his own party \u2014 as the election approached. A health agency created a <a href=\"https:\/\/www.newsfromthestates.com\/article\/florida-supreme-court-sides-desantis-dispute-over-state-abortion-webpage\">government webpage warning against Amendment 4<\/a>, DeSantis appeared alongside <a href=\"https:\/\/www.newsfromthestates.com\/article\/gov-desantis-lt-gov-nu%C3%B1ez-rail-against-abortion-rights-amendment-first-day-early-voting\">anti-abortion physicians<\/a>, and he got a <a href=\"https:\/\/www.newsfromthestates.com\/article\/tony-dungy-joins-desantis-clearwater-advocate-against-amendment-4\">former NFL coach<\/a>&nbsp;to speak out against the proposal, the&nbsp;Florida Phoenix&nbsp;reported.  \n<\/p> <p> \u201cThere were misconceptions and flat out lies about what Amendment Four was and what Amendment Four was not,\u201d said Keisha Mulfort, spokesperson for the state\u2019s American Civil Liberties Union affiliate who worked on Floridians Protecting Freedom\u2019s campaign.  \n<\/p> <p> In October, state health officials sent cease-and-desist letters to TV broadcasters threatening to sue them over a Yes on 4 <a href=\"https:\/\/www.newsfromthestates.com\/article\/tampa-woman-abortion-rights-ad-speaks-out-about-desantis-administrations-threat\">ad featuring a cancer survivor<\/a>, the <a href=\"https:\/\/www.newsfromthestates.com\/article\/us-judge-blocks-desantis-admins-threats-broadcasters-over-amendment-4-ads\">Phoenix<\/a>&nbsp;reported. The group sued the administration, saying officials were trying to chill free speech. U.S. District Judge Mark Walker agreed, <a href=\"https:\/\/floridaphoenix.com\/2024\/10\/29\/u-s-judge-extends-block-on-desantis-threats-to-broadcasters-over-abortion-ads\/\">saying<\/a> the Florida Department of Health could not intimidate broadcasters. Litigation in the case continues.  \n<\/p> <p> The abortion-rights group is also disputing a $328,000 fine stemming from a Florida Office of Election Crimes &amp; Security preliminary <a href=\"https:\/\/files.floridados.gov\/media\/708442\/oecs-interim-report-10-11-2024.pdf\">report<\/a>&nbsp;released in October accusing Floridians Protecting Freedom of \u201cwidespread election fraud.\u201d Campaign Director Lauren Brenzel <a href=\"https:\/\/www.newsfromthestates.com\/article\/abortion-amendment-sponsor-disputes-328000-state-fine-over-petitions\">refuted<\/a>&nbsp;the allegations, and Mulfort said the fine is also being litigated but can\u2019t comment further on either case.  \n<\/p> <p> Fifty-seven percent of Florida voters approved the abortion-rights measure, but Amendment 4 fell short of the 60% threshold required in the state, according to the <a href=\"https:\/\/www.newsfromthestates.com\/article\/amendment-4-fails-get-60-required-passage\">Phoenix<\/a>. Although a majority of Floridians voted in favor of abortion rights, the supermajority requirement means most abortions are banned after six weeks.  \n<\/p> <p> \u201cWe all will continue to look at the ways in which we can ensure that reproductive freedom is seen in Florida and that these abortion bans come to an end,\u201d Mulfort said. \n<\/p> <h4>South Dakota<\/h4> <p> Like Arkansas, South Dakota\u2019s abortion-rights group did not receive any funding from the national branches of Planned Parenthood or the American Civil Liberties Union. Democratic Illinois Gov. JB Pritzker\u2019s Think Big America PAC <a href=\"https:\/\/sdcfr.sdsos.gov\/Document.aspx?DocumentID=93607&amp;type=doc\">donated<\/a> <a href=\"https:\/\/sdcfr.sdsos.gov\/Document.aspx?DocumentID=93749&amp;type=doc\">$790,000<\/a> <a href=\"https:\/\/sdcfr.sdsos.gov\/Document.aspx?DocumentID=93537&amp;type=doc\">in the final weeks<\/a>&nbsp;leading up to Election Day.  \n<\/p> <p> Dakotans for Health was outraised by three anti-abortion committees \u2014 Life Defense Fund, No G for SD and Celebrate Life Committee \u2014 that raised $1.7 million, versus the abortion-rights coalition\u2019s $840,000 as of late October, <a href=\"https:\/\/www.newsfromthestates.com\/article\/500k-contribution-helps-abortion-rights-group-narrow-fundraising-gap\">South Dakota Searchlight<\/a>&nbsp;reported  \n<\/p> <p> <a href=\"https:\/\/sdsos.gov\/elections-voting\/assets\/2024%20Assets\/2024CARickWeilandabortionpetition.pdf\">Amendment G<\/a> asked voters whether the state should ban legislators from regulating abortion until the end of the first trimester, allow regulations during the second trimester \u201cin ways that are reasonably related to the physical health of the pregnant woman,\u201d and let the state prohibit abortion in the third trimester, unless the procedure is necessary to save the life or health of a pregnant patient.  \n<\/p> <p> <a href=\"https:\/\/electionresults.sd.gov\/resultsSW.aspx?type=BQ&amp;map=CTY\">Fifty-nine percent of South Dakota voters rejected the proposal, and 41% voted yes. <\/a> <\/p> <p> Dakotans for Health leader <a href=\"https:\/\/www.newsfromthestates.com\/south-dakota-abortion-amendment-rick-weiland\">Rick Weiland<\/a>&nbsp;chalked the loss up to a lack of resources. \u201cWe were in a tough spot. We knew that we needed to be on the air at the end. The last month or so, that\u2019s what we had budgeted for,\u201d he said. \u201cBut the other side of that coin, too \u2014 the reason we didn\u2019t have the resources \u2014 was that the national organizations had written South Dakota off, which was really unfortunate.\u201d  \n<\/p> <p> Weiland said he would not lead another effort to restore abortion rights in the state but would support other groups. South Dakota\u2019s ACLU and Planned Parenthood affiliates did not support the campaign and questioned its timing and wording at the start, according to <a href=\"https:\/\/southdakotasearchlight.com\/2023\/12\/06\/abortion-rights-groups-dont-support-ballot-measure-that-aims-to-restore-abortion-access\/\">Searchlight<\/a>.  \n<\/p> <p> \u201cThere\u2019s no middle ground in politics anymore,\u201d Weiland said. \u201cYou have to be beholden to the ultra-right or beholden to the ultra-left, and you can\u2019t do what we thought was the right thing, which was just restore the rights that women had for almost 50 years.\u201d  \n<\/p> <p> He challenged the Republican-controlled legislature to add exemptions to the state\u2019s abortion ban, which only allows abortions to save the mother\u2019s life. \u201cThey could declare a state of emergency, they could pass an exemption bill for rape, incest, and nonviable pregnancies, the governor could sign it, and women would have at least some access.\u201d  \n<\/p> <p> He said such a mechanism could be passed swiftly, similar to the way lawmakers fast-tracked a bill this year that <a href=\"https:\/\/www.newsfromthestates.com\/article\/responding-abortion-rights-effort-house-approves-bill-allowing-withdrawn-petition\">allowed citizens to remove their signatures from ballot petitions<\/a>. Republican Rep. Jon Hansen authored that bill. He also served as co-chair of the anti-abortion Life Defense Fund and is the incoming speaker of the South Dakota House.  \n<\/p> <h4>Nebraska<\/h4> <p> In Nebraska, voters faced an <a href=\"https:\/\/www.newsfromthestates.com\/article\/nebraska-voters-will-see-dueling-abortion-amendments-fall\">unprecedented pair of ballot questions<\/a> on abortion. One initiative asked voters whether to restore the right to an abortion up to fetal viability. The other asked whether to restrict access after the first trimester and allow lawmakers to further regulate abortion. Most abortions are banned after 12 weeks in the state.  \n<\/p> <p> Even though the abortion-rights group had the jump on organizing \u2014 launching in 2023, while <a href=\"https:\/\/www.newsfromthestates.com\/article\/new-better-ballot-initiative-seeks-ban-nebraska-abortions-after-first-trimester-pregnancy\">the counter effort started up only this spring<\/a>&nbsp;\u2014 <a href=\"https:\/\/www.newsfromthestates.com\/article\/nebraska-passes-abortion-restrictions-amendment-bucking-national-trend\">the restrictive measure prevailed<\/a>.  \n<\/p> <p> \u201cThe abortion restrictions amendment \u2026 left the door open for further bans and restrictions,\u201d said Andi Curry Grubb, Planned Parenthood Advocates of Nebraska\u2019s executive director. \u201cWe\u2019ve dusted ourselves off, regrouped and are prepared for what comes next.
